The Social Security Fairness Act was signed into law on January 5, 2025 and eliminated both the The WEP (Windfall Elimination Provision) and the GPO (Government Pension Offset).

If you worked in non- covered employment, you may now be eligible to collect higher Social Security benefits -- based on your own covered work record or that of a current or ex spouse (living or deceased).

The WEP (Windfall Elimination Provision) and GPO (Government Pension Offset) reduced Social Security benefits and either reduced or eliminated spousal, divorced spousal, widow(er), and divorced widow(er) benefits of those with pensions or retirement accounts from non-covered employment.

If you believed that the GPO would eliminate any spousal, divorced spousal, widow(er)s or divorced widow(er)s benefits and have not yet filed, you’ll want to file now to collect these benefits.

If you have already claimed your benefits and are eligible for increased benefits, you’ll want to request to collect the increased benefits available to you retroactively.

The Boldin planner did not have a WEP or GPO feature, instead we recommended that you turn off the Social Security benefit for the impacted spouse.
